Even though Calif. Gov. Arnold Schwarzenegger gets all of the publicity when he repeatedly vetoes the state’s payment card data protection legislation, similar data protection efforts in Nevada and Massachusetts have been much more quiet.

A law prohibiting the surreptitious reading of RFID tags is meaningless, and will be utterly useless except to harass legitimate researchers. The fraudulent use of a cloned tag is already illegal, _because it’s fraud_. There is no way for a police officer to “see” someone reading a tag using RF. This would only ever be applied if someone were arrested for fraudulent use — and at that point, they’re already under arrest for fraud!
We don’t need more laws, we have plenty of them in place already. What we need is the enforcement. If someone is stealing, regardless of how they’re doing it, lock them up. If they’re not, move on to someone who is. It’s a simple concept.
